Manual on the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000).

Introduction

This Manual is published in accordance with section 51 of the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) ("PAIA"). It sets out the procedure and grounds on which Fit City will grant access to records in its possession or under its control. The Manual is intended to assist requesters who wish to exercise their right of access to information held by Fit City.

The Legislation

PAIA gives effect to the constitutional right of access to any information held by the State, and any information held by another person that is required for the exercise or protection of any rights. Where a request is made in terms of PAIA, the body to which the request is made is obliged to release the information, subject to the grounds for refusal set out in PAIA.

Guide on How to Request Access

The South African Human Rights Commission ("SAHRC") has compiled a guide in terms of section 10 of PAIA, containing information to assist a person who wishes to exercise a right of access to information. The guide is available on the SAHRC website at www.sahrc.org.za or from the SAHRC head office. A requester may also contact the Information Officer for assistance in submitting a request.

How to Make a Request

A request for access to a record of Fit City must be made on the prescribed Form C, available from the SAHRC website or the Department of Justice. The completed form must be submitted to the Information Officer at privacy@fitcity.world together with the prescribed request fee (if applicable). The requester must provide sufficient particulars to enable Fit City to identify the record and the requester, and indicate the form of access required.

Records Held by Fit City

Fit City maintains records in the following categories: organisational records (registration documents, governance records); financial records (accounting records, tax records); operational records (event registrations, volunteer records, partnership enquiries); and personnel records (where applicable). Records are held in accordance with applicable legislation and Fit City's retention policies.

Records Available Without a PAIA Request

Certain information is automatically available without a person having to request access in terms of PAIA, including information on the Fit City website, marketing materials, and publicly published event details. No PAIA request is required for access to these records.

Records That May Be Refused

Fit City may refuse a request for access to a record on the grounds set out in PAIA, including the protection of personal information of a third party, commercial information of a third party, information that could endanger the safety of individuals, and information that is privileged or confidential.

Remedies

If a requester is aggrieved by a decision of the Information Officer to refuse a request, or by the fees charged, the requester may lodge an internal appeal or complaint with the SAHRC, or apply to a court for appropriate relief.

Availability of This Manual

This Manual is available for inspection at the offices of Fit City and on the Fit City website. Copies may be obtained from the Information Officer on request.
